Three men charged in the death of an Owen Sound restaurant owner made a brief first appearance in an Owen Sound courtroom on Friday
“It was an extensive report and I have reviewed that report,” the judge said.
Ontario’s highest court pointed to errors in the judge’s final instructions to the jury regarding the testimony of a reluctant witness.
The judge also imposed an indeterminate sentence.
Superior Court Justice Martha Cook said Grant Norton, 59, was “robbed, savagely beaten, and stabbed”.
Wesley Peters was supposed to go on trial for first-degree murder in January.
Koree Dockstater was found guilty on July 4 in the stabbing death of Shaniquia Henry.
Donald Wayne Earhart was convicted of first-degree murder in March 2008 for torturing and executing Ronald Sullivan.
The case will now be forwarded to the Scottish Ministers to determine if all three should be extradited.
Malik McDonnell-Mills died of a stab wound to the femoral artery on Aug. 9, 2023.
The existence of the recordings came up during Rose-Anne Van De Wiele’s eight days in the witness box.
The trial continues on Tuesday.
